Civil law is a broad category, which includes such diverse matters as personal injury practice, medical malpractice, breach of contract, libel and slander, collections, patent law, bankruptcy and trespass.

No attorney specializes in all areas of civil litigation, and there are some areas which should be left to the specialists. Some areas of litigation involve complicated laws, difficult facts, and well-funded defendants, and are best left to attorneys with enough experience and resources to put up a strong fight on your behalf.

By way of example, few attorneys have the experience and resources to litigate medical malpractice claims, patent claims, or antitrust claims. Some attorneys believe that they can litigate claims, despite a lack of experience in a specialty, and sometimes they are right. But most clients are best served by taking specialized cases to a lawyer who has special expertise in that type of case.

Litigation in Michigan is regulated first by Michigan's statutory and common law, and secondarily by the Michigan Court Rules. The statutes and common law define the causes of action which may be filed in a Michigan court. The Michigan Court Rules define the procedures that litigants must follow once their case has been filed with the courts. While most litigators develop a good understanding of the laws which govern their areas of practice, and of the court rules for the courts in which they practice, the laws and court rules can be very confusing for a layperson.
